Terms of service
1. Acceptance of Terms: By accessing atikawellness.com (the “Site”) or purchasing Advanced Skin Nutrition™ or any future ATIKA products (collectively, the “Products”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Site or purchase our Products.
2. Eligibility: You must be 18+ years old — or the age of majority in your jurisdiction — and reside in a country where the Products are lawfully sold.
3. No Medical Advice: Site content is for informational purposes only and is not intended to diagnose, treat, cure, or prevent any disease. Always consult your healthcare professional before using any dietary supplement.
4. Product Information & FDA Disclaimer: Statements on the Site have not been evaluated by the U.S. Food and Drug Administration. Results vary by individual. Ingredient amounts match the label and are verified through cGMP testing.
5. Auto-Renewal Subscription:
- Selecting Subscribe & Save authorizes recurring charges to your payment method for each shipment until you pause or cancel.
- We email an upcoming-order reminder at least 5 days before each charge.
- Cancel anytime in your account dashboard or by emailing hello@atikawellness.com before the next billing date.
6. Payment & Taxes: Prices are shown in U.S. dollars. Sales tax is collected where required by law. Payments are processed via PCI-DSS-compliant providers; we never store full credit-card data.
7. Shipping: Orders ship within 2 business days via tracked service. Risk of loss transfers to you upon delivery by the carrier.
8. Final-Sale / Replacement Policy: For quality-control reasons, all sales are final once the Product leaves our climate-controlled facility — we cannot restock ingestibles.
If your shipment arrives damaged, missing, or incorrect, email hello@atikawellness.com with photos and your order number within 7 days of delivery or as soon as you become aware of the issue. We will verify and send a free replacement of the affected item(s). This policy does not limit rights provided by applicable consumer-protection laws.
9. California Proposition 65: Finished lots test below Proposition 65 limits for lead, cadmium, arsenic, and mercury; therefore, no warning statement is required.
10. Intellectual Property: All Site content, trademarks, and formulas are the property of ATIKA, Inc. or its licensors and are protected by applicable intellectual-property laws. No content may be used without written permission.
11. User Conduct:
- Violate any law or regulation;
- Post or transmit harmful, misleading, or infringing material;
- Attempt to interfere with the Site’s security or proper functioning.
12. Disclaimer of Warranties: Products and Site content are provided AS IS without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.
13. Limitation of Liability: To the fullest extent permitted by law, ATIKA, Inc. will not be liable for indirect, incidental, special, or consequential damages. Our total liability will not exceed the amount you paid for the Product that gave rise to the claim.
14. Indemnification: You agree to indemnify and hold harmless ATIKA, Inc., its officers, and employees from any claim arising out of your breach of these Terms or misuse of the Products.
15. Dispute Resolution: Arbitration & Class-Action Waiver
Any dispute will be resolved by binding arbitration in the State of Delaware under the AAA Consumer Rules. You waive any right to participate in a class action or class-wide arbitration.
16. Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.
17. Changes to Terms: We may modify these Terms at any time. Updated Terms become effective when posted. Continued use of the Site or Products constitutes acceptance.
