Terms of service
1. Acceptance of Terms: By accessing atikawellness.com (the “Site”) or purchasing Advanced Skin Nutrition™ or any future ATIKA products (collectively, the “Products”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Site or purchase our Products.
2. Eligibility: You must be 18+ years old — or the age of majority in your jurisdiction — and reside in a country where the Products are lawfully sold.
3. No Medical Advice: Site content is for informational purposes only and is not intended to diagnose, treat, cure, or prevent any disease. Always consult your healthcare professional before using any dietary supplement.
4. Product Information & FDA Disclaimer: Statements on the Site have not been evaluated by the U.S. Food and Drug Administration. Results vary by individual. Ingredient amounts match the label and are verified through cGMP testing.
5. Auto-Renewal Subscriptions
By selecting a subscription option, including Subscribe & Save, you authorize ATIKA to charge the payment method on file automatically at the frequency and price disclosed at the time of purchase. Recurring charges will continue until you pause or cancel your subscription.
We will send an upcoming-renewal reminder to the email address associated with your subscription at least three (3) calendar days before each scheduled charge. Because email delivery depends on third-party systems and may be affected by spam filters, inbox settings, outdated contact information, or other circumstances outside our control, we cannot guarantee that every reminder will be received or opened.
You are responsible for:
- Maintaining an accurate and current email address;
- Reviewing the renewal schedule available in your customer account; and
- Pausing, modifying, or canceling your subscription before the applicable billing deadline.
Failure to receive or open a renewal reminder does not cancel your subscription, delay a scheduled charge, or create a right to a refund after an order has been processed, except where otherwise required by applicable law.
You may manage your subscription through your customer account or by emailing hello@atikawellness.com. Changes must be completed at least 24 hours before the scheduled billing date. Once a recurring charge has been processed and the resulting order has been submitted for fulfillment, the order cannot be canceled or refunded.
6. Payment & Taxes: Prices are shown in U.S. dollars. Sales tax is collected where required by law. Payments are processed via PCI-DSS-compliant providers; we never store full credit-card data.
7. Shipping, Delivery, and Risk of Loss
Orders are shipped using third-party carriers. Shipping and delivery dates are estimates and are not guaranteed. Risk of loss transfers to the customer when the carrier records the shipment as delivered to the address provided at checkout, except where otherwise required by applicable law.
Customers are responsible for providing a complete and accurate shipping address and for monitoring tracking and carrier communications. ATIKA is not responsible for delivery failures resulting from an incorrect or incomplete address, refusal of delivery, failure to collect a shipment, failure to pay applicable import charges, or failure to respond to a carrier or customs authority.
International orders are additionally governed by the International Orders provisions of our Shipping Policy, which are incorporated into these Terms by reference.
8. Final Sales; Damaged, Incorrect, or Missing Shipments
Except as expressly provided in our Returns & Exchanges Policy or 90-Day Results Guarantee, all sales are final once an order has been submitted for fulfillment.
If an order arrives damaged or incorrect, contact hello@atikawellness.com within seven days of delivery with the order number and supporting photographs. If an order appears to be missing, contact us as soon as reasonably possible so that we can investigate with the carrier.
Replacement, refund, and return eligibility will be determined under these Terms and the applicable Shipping, Returns & Exchanges, and Results Guarantee policies. Nothing in these policies limits any non-waivable rights provided by applicable law.
9. California Proposition 65: Finished lots test below Proposition 65 limits for lead, cadmium, arsenic, and mercury; therefore, no warning statement is required.
10. Intellectual Property: All Site content, trademarks, and formulas are the property of ATIKA, Inc. or its licensors and are protected by applicable intellectual-property laws. No content may be used without written permission.
11. User Conduct:
- Violate any law or regulation;
- Post or transmit harmful, misleading, or infringing material;
- Attempt to interfere with the Site’s security or proper functioning.
12. Disclaimer of Warranties: Products and Site content are provided AS IS without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.
13. Limitation of Liability: To the fullest extent permitted by law, ATIKA, Inc. will not be liable for indirect, incidental, special, or consequential damages. Our total liability will not exceed the amount you paid for the Product that gave rise to the claim.
14. Indemnification: You agree to indemnify and hold harmless ATIKA, Inc., its officers, and employees from any claim arising out of your breach of these Terms or misuse of the Products.
15. Dispute Resolution: Arbitration & Class-Action Waiver
Any dispute will be resolved by binding arbitration in the State of Delaware under the AAA Consumer Rules. You waive any right to participate in a class action or class-wide arbitration.
16. Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.
17. Changes to Terms: We may modify these Terms at any time. Updated Terms become effective when posted. Continued use of the Site or Products constitutes acceptance.
